Please be advised that the Judicial Council just adopted Emergency Rule 13 (the rule in its entirety can be viewed through the Judicial Council website). This rule deals specifically with modifications of support (both child and spousal). According the rule, an order modifying or terminating support may be made effective as of the date the request and supporting papers are mailed or otherwise served on the other party, or other party’s attorney. The rule further requires that the moving party re-serve the responding party after they have been filed. This rule provides parties with the formal ability to establish retroactivity dates. It also retains the court’s discretion to order a later effective date when appropriate. Judge Greg Syren |
