About the Section

The Alternative Dispute Resolution (ADR) Section promotes litigation alternatives by providing a forum for information-exchange and discussion, and serving as a liaison with the judiciary. The Section, led by the Executive Committee, also presents several MCLEs and networking opportunities throughout the year.

Mediating High Profile Cases

Some disputes capture public imagination because of their timely and poignant social import, others because of the notoriety or celebrity of the parties involved. This program, directed to mediators and counsel alike, examines the special considerations, dynamics, strategies, and ethics that can come into play when mediated disputes appear on the radar of public curiosity, interest, and fascination.

Barriers to Settlement

Whether as a litigator, transactional attorney, or mediator, negotiating resolution is difficult for reasons that are both obvious and subtle. Rational decision-making often gets consumed by other factors, and the process towards resolution can feel arduous and inefficient. This program focuses on understanding the multiple barriers – strategic, psychological, cognitive, cultural, and structural – that impede the rational negotiation process. Learn how to become a better negotiator for yourself and your clients.
