Attn CAAP Attorneys: November 15th Deadline for Outstanding Fee Declarations

CAAP Panel Attorneys:

As you are aware, under the current CAAP contract, the County requires the following:

·         payment of attorneys’ fees by the ACBA directly to panel attorneys effective May 1, 2013;

·         the implementation of hourly billing;

·         implementation of a monthly billing/payment cycle; and

·         implementation of an online billing mechanism.

Beginning in May 2013, the County began paying ACBA a fixed monthly amount representing reimbursement for work performed in the current month. Said fixed amount is adequate to pay panel members for work performed in a given month.

The shared expectation was that the County was to pay attorneys for work completed prior to May 1, 2013. However attorneys continue to request payment from the ACBA for work performed earlier than May 1—in some instances as far back as 2011. In order to determine the amount that should have been directly paid by the County, ALL FEE DECLARATIONS FOR WORK PERFORMED PRIOR TO MAY 1, 2013 MUST BE SUBMITTED BY NOVEMBER 15, 2013. This deadline is in addition to the regular November 15, 2013 deadline for fee declarations that include work completed in October.

THE ACBA WILL RETURN FEE DECLARATIONS SUBMITTED AFTER NOVEMBER 15, 2013, FOR WORK PERFORMED PRIOR TO MAY 1, 2013, UNPROCESSED AND UNPAID.

As funds received May 1, 2013 forward have been used to cover both current and “old” fee declarations, CAAP is in the position of being asked to pay for multiple months’ worth of work with one month worth of funds. Determining all amounts owing for “old” work accomplishes two things: closes out work and billing under the old contract, and helps the ACBA identify the amount needed to pay outstanding fee declarations in accordance with the fee schedule and rules governing CAAP, and if necessary, request additional funds from the County.

Regarding declarations already submitted, please do not submit declarations you have already sent. Declarations already received are being processed. Those that are substantially complete, but that include multiple calendar months of work are being held for later payment, as cash flow permits.
